RYA appeals for VAT evidence

Have you had trouble establishing whether VAT has been paid on your boat? Or have you been challenged either in the UK or abroad over the VAT status of your vessel? If so, the RYA would like to hear from you - urgently.

The RYA is continuing negotiations with HM Revenue & Customs and the Government over the difficulty boat owners experience when trying to establish the VAT status of their vessels.

And as a result the RYA is appealing for evidence that pleasure craft owners are being challenged both in the UK and abroad over the VAT status of their boat and are being asked to produce documentary evidence to prove the VAT status.

The RYA has a survey form on its website, and it is appealing for yachtsmen to return completed survey forms by the end of March, so that they have the evidence before their next meeting with UK Customs. “We need details of your experiences in order to show UK Customs that this is an important issue that needs to be considered,” they say.

“Please do complete the form which you can fill in online at www.rya.org.uk or you can request a hard copy by emailing Vat.survey@rya.org.uk.”

I'm wanting to buy an older (1970) boat in Sweden and bring it back to the UK. I note HM Revenue & Customs say if the original invoice/receipt showing VAT paid cannot be produced (as in this case), reprieve might be found under EU Single Market transitional arrangements: VAT is deemed as paid if it can be proved the boat was in use before 1 January 1985 and in the EU on 31 December 1992 (the dates are 1 January 1987 and 31 December 1994 for Austria, Finland and Sweden). Age can be proved with a marine survey, Part 1 registration, Insurance documents, or a Builder's certificate. Location can be proved using receipts for mooring or harbour dues, or dry dock records.
